Our Obligations

The Health and Safety at Work Act 2015 provides that a person may have more than 1 duty imposed on them at the same time if they belong to more than 1 class of duty holder (for example a duty to manage or control a workplace and a duty to install plant and equipment).

The Act also provides that more than 1 person may have the same duty at the same time.  In that case each person must discharge that duty to the extent to which they have the ability to influence and control the matter or would have had that ability but for an agreement or arrangement purporting to limit or remove that ability.

If more than 1 PCBU has a duty in relation to the same matter, each PCBU must, so far as is reasonably practicable, consult, co-operate with, and co-ordinate activities with all other PCBUs who have a duty in relation to the same matter.  

With regard to contractors, that means both the Company and the contractor are PCBUs.  Therefore both parties are obliged to consult and cooperate with each other and coordinate their respective activities to ensure so far as is reasonably practicable that all people on our premises are kept safe.
